Under international law it most certainly does. I saw the P.M. on tv a few weeks ago and raised that issue at a press conference: why is the zionist government importing vast amounts of firepower without interference but if Gaza attempts to import arms it is called "smuggling"? I think he had a point. They have as much right to import arms as any other nation - and to have hostile forces removed from their waters and airspace. |

Every country should have that right, and the right to shoot down any plane that infringes on their airspace without permission. The Israeli's have been known to down even commercial, passenger aircraft when they are even close to their airspace.

Yes they should shoot down any aircraft that violates their airspace. They should also be allowed a navy to protect it's waters. I think Hamas should sign a deal with Egypt or Syria or any powerful Arab nation which will provide it protection and represent it in the international community, and in return should allow Hamas self rule in Gaza Strip. This would be a win-win situation because Hamas is very popular in Gaza and Egypt can take the responsibility of arming Hamas to defend itself. Hamas already has it's military wing, so I think the "infrastructure" is in place, only the Arab nations need to help them financially to get armed to defend themselves. Hamas has shown an incredible capability to manufacture rockets with limited resources, given the proper conditions and resources they might be able to even develop powerful rockets for use by the Egyptian military or for export, thus strengthening the economy. As far as I am concerned, Hamas should declare itself independent and Gaza under it's control and allow itself to be represented by an powerful Arab nation, which can provide it protection and allow Hamas self rule. I feel for Hamas, they were democratically elected but the Jews did not like it and tried to isolate it. The Arab nations are useless if you ask me. They have all the oil wealth and no one can dare object them, but they are too obsessed with their multi-billion dollar "projects" like the artificial islands, entire cities bs. They do not realize that a fraction of their money given to Palestine will make a difference to them. They are too selfish to think about the innocent Palestinians being killed. It makes me want to think what can I do personally to make a difference to Palestine, besides praying which is the only thing I can do now.

I don't think they're a de jure state. They're in a very weird situation, as they're under foreign occupation. Israel has been trying for quite some time to say they don't occupy Gaza, yet it only recognizes the leadership in the PA and not the leadership in Gaza. Of course the West Bank where the PA has some control is entirely occupied, and under the Oslo agreements the two parts are one entity.
Under the Hague Regulations, the Occupying Power must protect the interests of the civilian population in the occupied territory - ensure food, water medical care and provide humane treatment for prisoners, respect due process rights and so forth. Well of course Israel has been regularly violating that. Also, recognizing the coercive power of occupying forces, I belive international law also says that those living under occupation cannot negotiate away territory (I'm not a lawyer, so don't take my word for it).
If Gaza truly weren't occupied they certainly would would have the right to a sovereign army, and if they had that army they probably wouldn't be legally occupied.
But bear in mind that Israel wants the occupation of Gaza to be considered ended. Probably because
a) it would then not be responsible for the health (food, water, medical care, even employment and so forth) for the Palestinians in Gaza (not that it's really ever fulfilled that responsibility )
b) The Occupying power may only kill people who are directly involved in harming the occupying forces, and only while they're engaged in harming them (also regularly violated by Israel), and must make every effort to use arrest and non-lethal means for its protection. If Gaza had an army, Israel could then attack it. Well, legally, they would have no justification for crossing outside their borders, actually, unless they were at war.
So here's my summary. Israel wants the occupation of Gaza, a territory it currently controls under belligerent occupation, to legally be over, in part so that it can legitimately be at war with it as a "hostile entity" and attack and destroy it. Go figure. |

Sure, but right now Gaza is in absolute shambles. In my opinion, it would be in Gaza's best interest to stop fighting and start focusing on the health and lives of the people living there. There isn't much there that actually is organized right now, and I think if they started trying to form and spend money on an army and more weapons it would just worsen the situation. What Gaza really needs is a stable government that actually cares about it's people and wants to help them and encourage positive relations with other countries. As a fledgling state in a critical situation, I think it is good that they don't have even more violence there, and I think they do need some guidance on how to control a people and a land.
