May I have a simple observation here?! If you are living in some EU country and meet your BF here(I do not know about the rules in North American context) I would say that: first make sure that your BF is really a Palestinian. I am saying that because I have heard some Arab people accepted as Palestinian refugees here in EU while they later admitted that they were from Egypt or Jordan or somewhere but claiming to be Palestinian(and somehow proving that) was a foolproof strategy to get refugee status and subsequently assuming the citizenship.
I have great respect towards refugees however and it sickens me when some(a few/ a lot/ whatever) Arab asylum fraudsters pass the borders as Palestinians and makes it even harder for real people in need of protection. I even heard that a decent looking guy claimes to be Palestinian with Israeli passport and later turns out he was from Gaza on refugee status(you never know)!!! |

There are three steps that should be taken for Palestine to sue Israel before the International Court of Justice for genocide. First, the President of the State of Palestine must deposit an Instrument of Accession to the 1948 Genocide Convention with the U.N. Secretary General, the depositary for the Convention. This Accession would become effective in ninety days.
Second, the President of the State of Palestine should deposit a Declaration with the International Court of Justice accepting the jurisdiction of the Court in accordance with the Charter of the United Nations and with the terms and subject to the conditions of the Statute and Rules of the Court, and undertaking to comply in good faith with the decisions of the Court and to accept all the obligations of a Member State of the United Nations under Article 94 of the United Nations Charter. Article 35(2) of the Statute of the International Court of Justice gives the Security Council the power to determine the conditions under which the World Court shall be open to states such as Palestine that are not yet Parties to the ICJ Statute. These conditions have been set forth by the Security Council in a Resolution of 15 October 1946. I would recommend that the State of Palestine consider making a "general declaration" accepting the jurisdiction of the World Court generally in respect of all disputes which have already arisen, or which may arise in the future, as permitted by paragraph 2 of this 15 October 1946 Security Council Resolution.
Pursuant to the terms of paragraph 5 of that Resolution, "All questions as to the validity or the effect of a declaration made under the terms of this resolution shall be decided by the Court." Therefore, it would be for the World Court itself to decide whether Palestine is a State entitled to exercise the powers conferred by the Security Council in its Resolution of 15 October 1946. For reasons explained in more detail below and elsewhere,1 I believe the World Court will decide in favor of Palestine on this matter of its Statehood.
To the same effect is Article 41 of the Rules of Procedure of the International Court of Justice:
Article 41
The institution of proceedings by a State which is not a party to the Statute but which, under Article 35, paragraph 2, thereof, has accepted the jurisdiction of the Court by a declaration made in accordance with any resolution adopted by the Security Council under that Article, shall be accompanied by a deposit of the declaration in question, unless the latter has previously been deposited with the Registrar. If any question of the validity or effect of such declaration arises, the Court shall decide.
The Security Council Resolution referred to in Article 41 that is now in force is the Resolution of 15 October 1946 mentioned above. |

It started when the Ottoman Empire fell in WWI. Parts of the Empire that were not organized enough to form their own governments were ruled by European powers. The UK was assigned to rule an area called the British Mandate of Palestine. It included what are now called Jordan, Israel, West Bank and Gaza. The UK was assigned to make it ready to govern itself.
First the UK wanted it to be made into a Jewish Homeland. But a lot of the Arabs there were against this idea. There was a movement against Jews among the Arabs in Palestine, led by Haj Mohammad Amin Husayni, an ally of Hitler. He and his followers wanted to remove all Jews from the Mandate of Palestine, and have Muslims only in an Islamic state. He was, in fact, the Father of the modern Arab-Israeli conflict.
So the UK gave most of Palestine to form Jordan. Some was given to form Israel. West Bank was part of Jordan and Gaza was part of Egypt.
Israel offered full citizenship to any Arabs that were living within its borders, as long as they were peaceful. But Arab neighbors made war on Israel as soon as it was founded in 1948, and many Arabs left Israel then. Israel won and continued to exist, and many Arabs stayed in Israel.
Ever since then, Arabs living in West Bank and Gaza have tried to destroy Israel with the goal of bringing it under Muslim rule and getting rid of the Jews. Fatah and Hamas both have this goal in their Charters. However, they have not managed to organize the people to form a stable government, as there is fighting among factions.
Israel took over West Bank and Gaza in 1967, in an effort to stop shelling of Israel from these lands. Around this time, I think, the name Palestine was appropriated by Arabs in West Bank and Gaza, rather than referring to the whole region, as it was before.
One difference between Israel and the unorganized Palestinians is their attitude toward defenseless civilians. Palestinian militants have attacked defenseless civilians almost exclusively, rather than taking on the Israeli military. And the expect Palestinian civilians to help them by surrounding Palestinian military sites, so that if the Israelis strike them, they will be killing civilians and children.
Israelis, on the other hand, avoid putting their own civilians in harm's way, and try to avoid killing Palestinian civilians. They even send warnings in advance of an attack, depriving themselves of the advantage of surprise, in order to encourage civilians to get out of the way.
So to make it short: Israelis kill Palestinians only in an effort to stop Palestinian attacks on Israel; it is the Palestinians themselves who put their own civilians in the way. Palestinians are shooting into Israel in hopes that terrorism will frighten Israel into giving up without a fight. |

Hamas is not a âresistance movement,â it is a terrorist organization whose attacks precipitated Operation Cast Lead. The groupâs behavior also violated international legal conventions and its fighters and leaders committed numerous war crimes.
United Nations Humanitarian Affairs Chief John Holmes told the UN Security Council, âThe reckless and cynical use of civilian installations by Hamas and indiscriminate firing of rockets against civilian populations are clear violations of international humanitarian law.â19a
It is a war crime to deliberately target civilians. Hamas indiscriminately fired rockets and mortar rounds at cities and neighborhoods in Israel since 2001. No UN resolution was adopted to condemn this war crime and no international effort was made to prevent more than 10,000 rockets and mortars from bombarding Israel.
Hamas also bears direct responsibility for civilian casualties in Gaza because it is a violation of international law to launch attacks from civilian infrastructure. According to the Geneva Conventions and other laws of war, civilians are to be protected and distinguished from combatants. This protection extends to civilian areas to minimize harm to innocents. Hamas provoked return fire on civilian areas by launching attacks from densely populated areas and, specifically, from inside and the vicinity of private homes, schools, mosques, and hospitals. In a report to the Israeli cabinet, Israeli intelligence chief, Yuval Diskin, indicated that the Gaza-based leadership of Hamas was hiding in an underground bunker beneath Shifa Hospital, the largest in the Gaza Strip.20 Hamas also endangered civilians by ordering its forces to discard uniforms and dress in regular clothes that made them indistinguishable from the civilian population.
In an egregious violation of international law, Hamas terrorists used civilians as human shields, for example, sending them onto rooftops to deter Israeli attacks on their leaders and rocket crews.
Hamas also violated the prohibition on the use of humanitarian symbols as shields. It is illegal, for example, for fighters to try to protect themselves through the use of âsigns, emblems or uniforms of the United Nations or of neutral or other States not Parties to the conflict.â21 Hamas repeatedly used humanitarian aid trucks and ambulances to transport fighters and weapons and launched attacks from the proximity of UN buildings and schools.
Irwin Cotler, a former Canadian justice minister, Member of Parliament, and law professor at McGill University, observed that Hamas also violates the prohibitions against the incitement of genocide. âThe Hamas covenant itself is a standing incitement to genocide,â says Cotler.22 In contrast to Israelâs military operation to defend itself from attack, Hamasâ violence targeting Israeli Jews is a part of a grander goal to kill all Jews.
Hamas attacks on Israeli civilians have been systematic and widespread, as opposed to infrequent, and are therefore defined in the treaty of the International Criminal Court and international humanitarian law as a crime against humanity.
Hamasâ final, and arguably most horrendous, war crime is its recruitment of children into armed conflict. From a young age, Palestinian children are taught hatred for Jews and are bombarded with images, written messages, and broadcasts that glorify martyrdom. They are often pressed into service to engage in or assist others in terrorist activities, including acting as suicide bombers.
Given the extent of their violations of international law, the world has an obligation to demand that the leaders of Hamas be charged with war crimes. |

Basic facts for you:
The term 'palestinian' always referred to the Palestinian Jews that have lived in that region for the past 3500 years.
The Palestine Post newspaper, for instance - was 100% Jewish. It later became the Jerusalem Post, and still exists today.
The Palestine Philharmonic Orchestra - again, it was 100% Jewish
In the early 1900s, some European Jews came over to join the Palestinian Jews. They were on deserted land. No other groups living there - it was mostly swamp, marsh. The Jews drained the swamps; quite a number died of malaria.
But they worked hard, and began turning the desert and sand dunes into a viable place to live. This, in turn, provided more work, and a large number of Arabs, from the surrounding Arab nations, came to live and work there also.
Fast forward to 1923: Jordan is created as an Arab state. She takes up 82% of what WAS Palestine.
1948: the Brits, who held the legal rights to Palestine, finally fulfilled their promise to create a national Jewish homeland there - the move towards this had been going on for over a CENTURY!
18% of Israel remains: a bit goes to the Palestinian Jews, the rest goes to the Palestinian Arabs.

Understandably, the Palestinian Arabs were scared and MOST fled. Those that stayed, became full Israeli citizens. But those that fled, were THEN abandoned BY the Arab world. They were stuck in terrible refugee camps. So Gaza was occupied by Egypt - Egypt mined the borders and wouldn't let the Palestinians out. Jordan occupied the 'west bank' and again, left the Palestinians to rot in refugee camps.
That's a brief summary of a complex history!
