I was reading that on MSN, and the baby was considered Canadian because she was born over Canadian Airspace.

the baby is canadian it was born in canadian airspace but it will be eligible for dual citizenship of canada and the mother's home country. But I have another question who takes an 8hr flight when they are 8 and 1/2 months pregnant?

I am pretty much up on the laws since I am a citizen of a few western countries. But I saw something on the news today that made me think.
Flights from Europe generally swing over Canadian territory before entering the US. Apparently since the child was recorded as born in Canadian airspace the child will be granted Canadian citizenship.
I suppose if the child was born over international waters... say a few minutes earlier the kid would just be whatevr citizen. If the kid was born as the plane was landing it would be a US citizen.
No women can time that out if she was trying something.

As far as citizenship (or nationality), being over Canada is likely irrelevant. Being en route from The Netherlands to the US probably doesn't matter, either. The registry of the plane may matter, and the parents' nationality definitely matters.
Oh, by the way, all of the countries involved or possibly involved don't necessarily view things they same. In fact, I'd say it's pretty likely.

It's the place where the plane is registered. Eg. if it was a KLM flight it would be considered Dutch territory.

Heh, I also saw the video, very interesting it was. Assuming at least one of the parents holds an American citizenship, the baby would be issued dual citizenship - Guyanese & American. If not, the baby is simply a Guyanese citizen.
