I think you'd be opening a very large can of worms. I am not fat, and I do find it a little uncomfortable when someone spills over into my seat, but before I'd act on that, I would:

1) ban small children who kick my seat for the whole flight
2) ban perfume and cologne (especially aqua velva)
3) ban people who smell like they smoked a pack of cigarettes before getting onto the plane
4) ban people with really loud voices who won't stop bragging to the guy next to me about their important job and philosophy on dating after divorce
5) ban people who are disagreeable with the flight attendants

it will be in time to come,but not in the near future.. airliners start to improve or actually make u pay more for traveling in comfort,bigger better seats in higher classes..gas prices are going up n eventually they will make u pay for yr weight tobe transported,starts from public transports like buses/taxi (weight n pay)n motorcar (u pay more for gasoline when u hv a loaded truck)..it hv to be progressive changes..

Tell the flight attendant you are absolutely unhappy sitting next to the fat person. Then, if they don't help you, tell another flight attendant until you are reseated.

Not all of the monstrosities on airplanes are fat. I've had some perfectly comfortable flights seated next to an overweight person who was at least polite and tried to be nice and as respectful as possible even though they were a little too close for comfort. I've also had some miserable flights seated next to lanky guys who thought it was OK to stretch and wriggle and invade my space the entire trip. Until you can regulate that behavior, flying is always going to be a little unpleasant.
