Bribery: Sin or Immoral?

just now i received a call from Kementerian Dalam Negeri (KDN)'s officer demanding RM10,000 (for the officer) + RM200 (for the clerk) just to make sure that our application for publishing a magazine will be granted ...

should i report this matter to higher officer and my application will be pending ... or just give him the money and this thursday i will be granted the license ... huh ...

Ask for receipt. Get them to sign the acceptance of the cheque with ic number. They will be more careful next time.

I had the same dilemma in Malaysia while waiting for a business bank loan. The clerk at the bank told me it could take up to 3 months to get approval but he could help speed things up and could get it approved within 2 weeks.

He didn't actually mention a price for 'helping' me but I was told it's normally around 10% which would have been $8,000 in his back pocket. In the end I turned down his 'kind' offer of help and had to wait the full 3 months for the loan, but I slept well at night if you know what I mean...

The choice is yours.......

Its a sin and its immoral too. Its a Catch-22, or no-win situation especially on your part. What does your conscience says? If you feel that the returns from the magazine is so great so as to constitute bribing government a**holes without the slightest remorse of your actions, then go ahead. But the fact that you've raised the question of sins and immorality, it shows that your conscience are on the right path.

Try manipulate your ways into this. Tell him that you don't have that much money because a lot of it has been pumped into the publication. Continue to be extra nice to him and play with his sympathetic feelings so that it'll be harder for him to ask for the money blatantly. If you give him the money, you're doing nothing to stop the cycle of bribery. Let us all put a stop to their greedy demands and teach them a lesson.

Bribery is both sin and immoral. I have gone through the same situation a number of times and to get things done faster , i had no choice but to "give out" to them. Most of the time the amount was a few hundreds depending on the case. Sometimes it could be much lesser than that. Once they have requested from you and if you do not give, they'll give all sort of problems to you , they'll delay your application, requesting for endless and sometimes impossible documents and worse they'll tell you file is missing and you have to submit another new application.

In your case, RM10,000.00 is just to much and i am very suprise that this particular officer of yours even had the guts to call you and set an amount for you. So far, of what i have gone through, the officers were very discreet and did not even give any ultimate amount. I think in your case, he probably think that the publishing licence is very important to you and your magazine may involve wide circulation, that's the reason he dared to ask so much from you.

In your case, perhaps you need to report. Before you take any action, get details of your application like asking is every documents in order or is there anymore problem and then get your acknowledgement letter which you received earlier and go to see his superior. Don't mention about anything about "money" first and see what the senior officer's answer or reaction. A good officer will sometimes get your application file his clerk / officer to check and if he tell you that there is no problem and thank the senior officer and go back to see the officer and inform him that his boss has said your application has no problem. He has no choice but to issue the licence to you. This is from the best scenario point of view. The worst scenario which i believe may be in your case is that everyone involves want to get some share of that money , right from the most senior officer to clerks.

At the same time, do understand also that even if you go report to the ACA, your case will not be entertained diligently and in the end , your case will be closed for lack of evidence. This happens all the time in ACA. Perhaps next time when you see the officer, stand by a tape recorder and record your conversation with him so that it can be used as evidence.

Sin is too often subjective. For some, it may be a sin, for others, not so much. Thus, whether or not it is a sin will be irrelevant to you. Bribery is a persuation tool based quite often fueled by greed (often for money in exchance for something else). If this is considered unjust, perhaps unfair, then it is immoral.

I would, in best judgement, report this matter, if for the sake of honesty.

do not report it to the higher officers or authorities, they may just like the officer or may be the money will be given to his boss, just report it to opposition party DAP Keadilan PAS - they are hunger for issues for the general election.

i dont know what's a sin according to religious teaching, so i wouldnt put bribery under that category. neither would i do in immoral if you are the giver. unethical, perhaps is what i would classify it under.

it does not seem wise to pay out that money especially if it is within professional context, plus with the legal background you have, you ought to be extra careful with this. it may seem like an ordinary thing that malaysians can turn a blind eye on, but you never know who is going to back stab you one day. so, better be paranoid than sorry.

my sister was asked to pay an amount of money so she could pass her driving test. she refused and failed on the first five attempts (unfortunately by the same examiner!). on the sixth attempt, she finally got another examiner who passed her with no "cross" at all. at least she could stand proud to say she can really drive...

well i suggest you consult with your superior before any decision. they know better, so you have something to cover your own ar.se

in my opinion,you should definately report to a higher officer,the highest if possible but make sure you have complete proof and evidance to back up your report
this is a matter that should not be taken lightly
it would not only be unfair to you but also those in the future who are asked of the same price in a matter which should have been your rights

both...sin & immoral...we have the same problem with the gov servants...everytime we need something they will always ask for duit kopi...if we deny it they will slow the work...but if we give then they will keep on asking for the duit kopi again and again and again...if we report...guess what they do???hmm...its either they lost the file/documents or they will keep with them forever...i think you shouldnt give them what they want...

This is a hard one to answer. You can call it immoral, sinful, unjust, unfair or anything under the sun to that term.
Keep in mind these charity you donated out is not only for the collector. It share among all from the bottom of the stairs up. So they too can get a step up the ladder.
