Should Nurin Jazlin's parents be charged for negligence?

As reported here
http://thestar.com.my/news/story.asp?file=/2007/9/24/nation/18975547&sec=nation

Nurin was let to walk alone to night market just near her house. Do you think it is fair to add to their misery?
Additional Details
In my opinion, having a law to make leaving a child to walk alone even around the house an offense symbolises a great fall of morality and safety in our society that we need such law to exist. I remember when I was a kid, children are free to roam around our kampung alone, even we could walk to neighbouring villages with no worries whatsoever. Now parents must, and are forced to, to be more strict and restrict our kids' movements for their safety. Good ol' days....

My opinion is ..

the parents of Nurun Jazlin already learn the lesson..
why we want to charged them, looking at the misery they've been thru... do we have joy by making her/his life more miserable than now??.. what does this make us look like...
i bet u they've learn the lesson already..
please let them rest in peace.. it will take them years or maybe a lifetime regret on what happen... dont think its necessary no more to charged them...

in fact, i think its better next time enforcement be taken to other parents.. take a case where i read few days ago where a parent lock his son in the cage.. that we need take note or charge.. or maybe in the case where negligence of parents leading to lepak or rempit or selling dvds or others...
this should be tackle not punishing that's already been at the tought situation..

what i do suggest that government should impose curfew (perintah berkurung) for kids under certain age (less then 12yrs) for let say 8.00 o'clock & below (to walk alone in the public)..
there's better way to do this rather than just punish ppl that already know the lesson...

Sure, why not?

Let it be a lesson to ALL that they SHOULD be responsible for the LIFE and SAFETY of their own kids.

Its a Malaysian syndrome... take things easy and blame it on others when 'shti happens'. Why don't they realize that its their own mistake?

Now that the girl is gone (dead), does it really matter anymore on how she was killed whatsoever? The main issue now is that she's dead and gone and someone has to be responsible for it. Putting the blame on that killer is just NOT enough.

We can say that a person is responsible for his/her own actions according to their sense of judgment. In this case, it is NOT on the child's part to play but the parents considering the fact that she is still weak and feeble, not being able to fend for herself (even adults do fall as victims, but in this case, she is WAY too young and ALL responsibilities should befall upon the custodian/parents of the child). So, if parents could allow their underaged child to go wandering into PASAR MALAM all alone, then... they're asking for it. WE ALL KNOW WHAT KIND OF PEOPLE WE ARE LIVING WITH, COME ON... LET'S WAKE UP, SHALL WE?!

By the way...

How long is this 'hoo-ha' going to last? 1 month? 3 months? I bet that within less than a year, the whole Malaysia will be back to 'normal' once again... and someone will say 'who cares?' and 'I don't know about it'... so, I won't doubt the possibility of this event to happen once again. Its not unusual in a place like Malaysia...

MY OWN BROTHER was cornered by 5 guys who assaulted him in the middle of SS15 Subang Jaya. He called for help but bystanders RAN AWAY... you expect anyone to get involved if whistles were given to kids for 'safety measures'? We're living in a bunch of cowards, for crying out loud! And we've just learned that the SUBANG JAYA Balai was 'covered' by those hooligans for only RM400.00... so, that's what my brother's life is worth, FYI.

Talking about saving another's life... I've got better things to think about right now.

Cooperation with the police? Yeah sure... but with that RM400.00... EACH AND EVERY EVIDENCES provided to them were destroyed or being given in return to those hooligans... can you trust the police these days?

Go figure...

On the public bus crashes... it was once a 'national issue'... but today, what's going on?

"One death is a tragedy, one million is a statistic"...
(Joseph Stalin)

I guess with the 'backward' ways of the government 'some people', this is just a mere 'statistic' for them... How do you feel about realizing that your very own life is just worth in mere 'numbers' in your own country?

booyah
As a parent myself. I would bear the responsibility...we are adult. I would never, NEVER let my child walk alone or go somewhere without me or my husband assist .
I know the parents were sad enough. But without being charge... Other parents won't learn !...and there will be repeats cases like this in the future.

golituk
It is better to find the beast before charging the parents, I would say. Law is law but having the beast laughing out loud when he read the news about the parents getting charged and he is still out there looking for new victims made me think that if I am the ketua polis negara, I will get more kereta peronda and get all the polis peronda to ronda everywhere and not just at some certain black area. Charge the parents when they get the beast..

why not? the parents deserve sympathy but they are also partly liable for the incident.

havent we all heard of the Mccanns? leaving aside the possibility of murder, the parents were going to be charged with Negligent Homicide.

many "accidents" are preventable but for the negligence of the parents. you leave a small child unattended in a yard with a pool and say if the child falls into the pool and drowns. is it an accident? perhaps, but it is also the direct result of negligent behavior where the individual being charged should have foreseen the possible death by drowning of a young child unattended child. in some other countries, given the same circumstances, the parents could even be charged with manslaughter.

"having a law to make leaving a child to walk alone even around the house an offense symbolises a great fall of morality and safety in our society that we need such law to exist."

if that was reality then we have to face up to it.

edit --
an offence against an act/statute is NOT necessarily an offence against the state. it will only be such if it was a crime or punishable by criminal sanction

>>Damien TheBear & TheBear 3.0V.....I completely agree with you!!!

Everyday, I see very young children walking along the road, lane and everywhere.......alone!!
Parents should...no....MUST be responsible and wary.
Why was Nurin all alone walking to the night market?? To buy some food....why all alone?? Why not the mother too??
Personally, I find most parents too lackadaisical these days even though they know that the outside world is full of insanity and yes, people are getting sicker these days!!!
In Malaysia, it takes one tragedy for all the ''ants'' to come out...then, all silent again.....another tragedy and all the ''ants'' will appear again...then, silence.....this is the norm and everyone knows that....

Sarah the cat's mum... one month is nothing...

My brother's case is almost half a year now with over 12 reports of more than 6 different charges on our assailants... yet, they are still questioning us as VICTIMS if we made up our stories...

So you tell me... some people say that we complain and whine but they don't know what we're going through or have been doing to improve the situation.

We work with the police, but the result of bribery and corruption had taken a twist. There's NOT a single police officer we can trust now, especially if they're from Subang Jaya and we can't make any reports against our suspects because they will be informing them about our reports and more threats will come to us instead.

Most recent event ---some guys attempted to dig my brother's eyeballs out because he could recognize them, and they attacked while my mother was driving the car!

I can tell you in and out on how Bukit Aman operates through our repetitious visits and the things we've been going through with the police. FYI, certain 'important areas' in Bukit Aman has no CCTVs... how's that for PDRM's headquarters?

The police officer who was assisting with our case had his computer and mobile phone sabotaged by 'insiders'...

a part of me blame the parents. People always forgot this proverb.....

Since the Nurul Huda case, i always remind my junior sibs to becareful everywhere they go, and never let my youngest sis (7 year old ) cycling to shops alone......

What in the sane mind of a human can do such horrendous things to a small innocent defenseless girl?? Only a pshychopath living silently under the radar of the society is capable of that.

What in the sane mind of a politician to say that the parents are to be charged for negligence when they have just lost their daughter to such brutality?? Only an indifferent one attempting to shove off the responsibility to protect the nation.

Both acts are equally inhumane.

I totally agree that the Police, a whole lot of them are receptive to briberies. The political climate and the national security are very unhealthy here in Malaysia. Not that I do not love my country, but it is the people who govern and hold positions to protect us that are in questions. If you are caught for an offence, you can be easily let go with some duit kopi 'o' . At times I wonder if the impetus for them to work is to protect fellow citizens or catching people with small offences that lead to some financial gains. I may be generalising but a bad apple spoils the whole basket, and sometimes it's the pineapple that's bad.

Time to vote with sense and sensibility.

daniel*wm
Now that's the problem, if you think you can't handle so many child just don't have so many babies but i'm sorry for them to hear how their child died...and it's really bad enough to go through this misery.

Please leave her parents alone, don't disturb them, they are going through a very hard time now. I don't think letting chiselers alone to pasar malam is a good idea, but Malaysia is advertised as a safe country, so it's those who dare to say Malaysia is safe are the ones who should be taken actions against. Don't disturb the parents, no money can give them their daughter back and it's a pain from that they might never recover.

I am not sure whether the parent had "committed a crime against state" ... ? haha i wonder what the government is thinking ...

charge for negligence? ... no way man ..

u can sue for negligence but not charge for negligence ...

Nurin's father will NOT be "charged" for negligence ...

----edit----

ok seriously ... the law does not provide a provision to charge parent for their negligent conduct which cause the children suffer or died.

if the gov. decided to amend the law ... it will jeopardize Nurin's parent ... so from my limited knowledge ... i conclude that the parent will never be charged for negligence.

----edit----

that is for the offence of neglecting a child ... or abandon the child.... not apply to Nurin's case because it was his slight mistake or negligence which we can never found in law that allow a gov to take action.

something said to cover up for malaysian police weakness. what took them so long? it's been a month since she's gone and yet, no clues?

what is that?

it's not fair. because whatever it is, i strongly believe authorities and society MUST play a part in making our place safer.

I used to roam around freely when i was little. i even walk to school which were quite far from my home. there's nothing to worry at all.

people now are getting sicker.....
