You will need to provide evidence to the immigration department that you have sole legal custody of your step-daughter, specifically the court order granting you custody. Look at page 39 of http://www.immi.gov.au/allforms/booklets/1119.pdf for the specific information. |

I would get some sound legal advice first. You don't want to be having a wonderful time then have it shadowed by the father accusing you of kidnapping or the sort. Far better to cover your options and know your rights from the start. Plus, i hope you have a wonderful, rich and full life in Australia with plenty of love and laughter. *smiles* |

If he still has parental rights you would need to ask him if your stepdaughter is under 18. If your wife was not married to him then he would not have automatic rights. Its worth checking with say citizens advice who offer free legal information |

Very likely you at least need the court's permission, in the absence of the father. Sometimes they will have law enforcement look for and contact the absent parent (they have a much easier time finding people). In your case you are emigrating versus just a visitor's visa, so the requirements are more stringent. As I'm sure you aware, there are plenty of women who lie that they don't know where the guy is and the truth is, they never notified him. |

I wouldn't think so. By the sound of things, he doesn't have any visiting rights to her and no parental responsibilities. I would contact the Department of Immigration and Citizenship at the nearest Australian embassy or consulate to make doubly sure but I am pretty sure her mother's signature would be sufficient as the custodial parent.
I hope that your family enjoys Australia.
