This is a job for the insurance agency, not a lawsuit. That's disgraceful to sue an airline for something that they weren't responsible for. It's called insurance.
What's next, people suing the council because they tripped on some uneven pavement? |

If you don't have enough health insurance to cover your injuries then you may not have any choice. Don't forget too that the plunge in question is the one that happened over Western Australia that caused some people on the flight to have injuries of major severity, such as spinal injuries. The preliminary investigation seemed to point to a systems failure in the Aircraft's computers. Its not exactly uneven pavement if a plunge of this nature maims you for the rest of your life and impacts your future quality of life permanently. Getting compensation may require suing all groups that could potentially have caused the incident. If they don't then each group could blame whoever is not being sued (the ground radio interference, Airline Manufacturer or Airline) for being responsible. Whoever gets believed gets off paying.
So suing the Airline might well be a legal necessity even it is morally pretty sad. If the investigation finds that the incident could have been prevented in some way, then those passengers suing will have a case to make in court.
I will leave that for the courts to decide.
Note: even if you had your seat belt on, a plunge at that speed and force could well still injure you pretty badly. If you didn't get whiplash, you could still end up with a broken pelvis or injuries from stuff flying around the cabin. |

actually, I don't think the insurance agency should even have to pay for that. when you get on a plane, you should know that theres a possibility of turbulence in the air. its only common sense. thats why you are suppose to keep your seatbelts fastened!!!! |

I agree. Apparently the reason that McDonalds have a hot warning on their coffee's is due to the fact that someone sued them after they received burns. WTF? Common sense denotes that chances are, the coffee might just be a little hot??
On an aircraft, there is a possibility that not only turbulence occurs, but the possibility that the plane may take an unintended detour and fly into the ground at 900km/h. These are associated risks of flying, If you cannot accept them, then take a boat. Same goes for anything. If you cannot accept the associated risks, then don't do it. Simple really. |
