The border probably will not even notice... that really isn't what they are looking for.

BUT - don't do it!!
That one unbuckled person flying around the van in an accident can cause injuries to everyone else, and it isn't fair to them to put them at so much more risk of injury and death than everyone sitting around them.

People still remember this accident so well even though it was a couple of years ago... make sure there is a way for everyone to buckle up. You can rent a van that can safely seat all 8.

Well, according to Ontario's Highway Traffic Act
R.S.O. 1990, CHAPTER H.8

"106. (1) No person shall drive on a highway a motor vehicle in which a seat belt assembly required under the Motor Vehicle Safety Act (Canada) at the time that the vehicle was manufactured or imported into Canada has been removed, rendered partly or wholly inoperative, modified so as to reduce its effectiveness or is not operating properly through lack of maintenance. 2006, c. 25, s. 1.

Use of seat belt assembly by driver

(2) Every person who drives on a highway a motor vehicle in which a seat belt assembly is provided for the driver shall wear the complete seat belt assembly as required by subsection (5). 2006, c. 25, s. 1.

Use of seat belt assembly by passenger

(3) Every person who is at least 16 years old and is a passenger in a motor vehicle on a highway shall,

(a) occupy a seating position for which a seat belt assembly has been provided; and

(b) wear the complete seat belt assembly as required by subsection (5). 2006, c. 25, s. 1.

Driver to ensure young passenger uses seat belt assembly

(4) No person shall drive on a highway a motor vehicle in which there is a passenger who is under 16 years old unless,

(a) that passenger,

(i) occupies a seating position for which a seat belt assembly has been provided, and

(ii) is wearing the complete seat belt assembly as required by subsection (5); or

(b) that passenger is required by the regulations to be secured by a child seating system or child restraint system, and is so secured. 2006, c. 25, s. 1."

All other provinces have the same rules.

Basically, when you are pulled over by the police for having too many people in the van, everyone over the age of 16 will get a fine, the driver of the van will be fined for anyone under the age of 16 and you will not be permitted to continue your trip until you resolve the problem.

If you make it to the border without being pulled over by the police, you will get fined at the border. Guaranteed!

My advice? Don't do it. Just don't.

If they happen to notice, they will not permit you to cross and they will call the proper authorities to write you a ticket.

They couldn't care less. that's not really there job.(Border Patrol)
IF you got stopped by the regular police, you'd probably get a Warning/minor ticket.
