Can I drive without a licence in a parking lot in Ontario, Canada?

I'm 23 years old, so not a minor, but I don't have my licence yet. I plan on going for my G1 in April so in the meantime, my husband, who has been licensed for 12 years, is trying to teach me to drive. When he took driver's education classes 12 years ago, the instructor told him that it was legal to drive in a parking lot without a licence. We are unsure if this law has changed. He has only taken me once so far, in the evening in an empty mall parking lot, and we planned on continuing to do this; drive only in a parking lot that is empty.

Is this legal or illegal where I live?

You must have your written test/learner's permit done first. Parking lots are private property and some laws do apply.

Your instructor was correct, legally you don't need a license to drive in a parking lot. It is considered private property (which is one reason you won't see anyone getting a ticket for blowing a stop sign in a parking lot since they are not sanctioned signs from the City) so the HTA does not apply.

Sec 32(1) states "No person shall drive a motor vehicle on a highway unless the motor vehicle is within a class of motor vehicles in respect of which the person holds a driver’s licence issued to him or her under this Act. R.S.O. 1990, c. H.8, s. 32 (1)."

And under Sec 1(1) "highway” includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof; (“voie publique”)

At the same time though, a vehicle and its driver must be insured so if you are driving the vehicle without a license, parking lot or not, your vehicle's insurance is nul and void. It is this that technically makes what you are doing illegal. Go get your beginners and you will be golden.

Haha! That's awesome! You said you didn't want to learn how to drive? What changed? Are you getting sick of walking in the snow and icy weather?

Good for you though! I have no idea if it's legal or not. Just don't get caught! If you're careful you should have no problems, it's only 2 more mths and you'll have your G1.

How's it going anyways? the lessons that is? is your hubby a nice teacher?

Well here in Quebec everyone does it for practice. You have to be accompanied by someone who has a licence, though. I think it is legal. Everybody does it. I sure did, and it was only 4 years ago ;)
edit : i had my done my written test tho.

I am pretty sure that driving in a parking lot is still legal because it is private property.

just drive in there and if you get pull over tell them that you didnt knew. You have to learn somewhere
