Crossing border with expired photo ID?

My fiancee has been living with me in Canada for 6 years now and needs to go back to the US to see his family. Thing is he doesnt have a passport. He has his license but it has expired and also has his birth certificate. If he is flying from Canada into the US what problems will he incounter without VALID ID? I just need to know if he can take a plan from Canada into the US or if I should drive him into buiffalo and he takes a plane. There has to be a way for him to get into the US. Hes an american citizen and they have to let him into his home country. Please help as he is travelling in the next month. THANKS

Go to his local embassy and check, they will not let him on the plane with the expired ID, luckily he has his birth certificate so he can get a passport

If he has lived in Canada that long, he was required by law (after about 6 months) to trade in his US license for one in the province he was residing.

You don't mention whether he has a visa or even permanent resident status - although with that time under his belt, he definitely should have managed both. If he had no visa or only a tourist visa classification - and was working (or studying), he is in violation of the immigration act and can be actively deported NOW. If he goes through the border - without a valid visa attached to his name - he will not be let back into the country for an extended period ... typically around 10 years.

To fly into the US, he requires a valid passport - it's the only acceptable identification for proof of citizenship these days. To enter by other means (boat, train, or auto) he must have proof of citizenship (which means a birth certificate or passport) and a VALID, government-issue photo ID (driver's license or passport or military ID).

It doesn't mean they WILL stop him crossing the border, but they have the RIGHT to refuse him entry. Even if it his native country. Similarly, Canada has the right to refuse him entry back into Canada as well ... as soon as he's left the country.

If you do not meet the criteria stated for entry, a country does NOT have to let you enter ... even if you are ostensibly a citizen.

Since he's been out of the US so long, he is no longer a US 'resident', even though he maintains his citizenship (obtained by birth). This is sufficient grounds for them to block his entry, particularly if he does not have the required identification.

I live in Niagara Falls, Ontario and I usually fly out of the Buffalo Airport.
You will have a lot less hassle if you cross the border by car than if he flys from Pearson. You can't even board a plane from Toronto to Montreal without valid photo ID. Drivers Licence is fine but Health Card doesn't count.

Get him a learner driving license ,it'll work as photo id.And get him his US passport and Canadian too urgently.

He won't be able to fly across the border without a valid passport. Land crossings are okay with ID/proof of citizenship until January of 2008.
If he has a birth certificate, then the best advice would be what someone earlier had suggested: for him to get a learner's permit or a photo ID done up at the Motor Vehicle Registry of your province. You *need* to have proof of citizenship (either Canadian or American) to get across the border on land, along with valid photo ID.

In January of this year, the US passed a law stating every individual going into the USA must have a valid passport, including it's own citizens. I'm a Canadian living in Mexico and US/CDN citizens can come into Mexico with photo I.D. and a birth certificate. But since January, these people have not been able to return to the US. The consulate here in Guadalajara provided them (US citizens) with quick passport applications that helped. It's a very different world out there these days, and before traveling anywhere outside of your country, make sure you do your due diligence and find out these things first.

do it quick!!!!!!!! i went in for passports 10 weeks ago and just got them YESTERDAY!!! They are extremely backed up! If by plane they will not let him back into the country, even tho he is a resident. However, i believe that it is different by sea or car. (I think!)

If you call them tho, have patience, i've spent over 2+ hours on the phone during 4 different phone calls!!

sounds like a valid question to be asking the INS/border service for the US. He is a US citizen, but residing for 6 years in Canada. Is he in violation of Canada's immigration policy? Lots of cans of worms this can open up.
