AFAIK, no collection agency anywhere in North America has the right to gain access to your bank account and take money without your consent. Getting your account frozen (by court order) isn't the same as having money actually taken out -- its a way for the collection agency to get your attention, so to speak, and force you to come to some agreement with them to settle your bill.

Collection agencies can only do certain things, such as arrange to put a lien on your property, freeze your bank account, or arrange with a court to have bailiffs seize your car, furniture, etc. They can and will threaten you with prosecution and may call you at various times of the day at both home and work.

My advice would be that if you are being hounded by creditors and it has got to the point that a collection agency is involved, you may want to discuss your situation with your bank manager, a financial aid counselor, or the local legal aid office.

Do you have insurance? If so, check with them and they may have legal services that will let you discuss issues with a lawyer free of charge.

Collection agencies are usually called in to do the dirty work when the company which you owe money see that they are getting nowhere with you or that you keep ignoring them. They don't want to have to deal with you anymore. It is always best to handle things before they get that far and try to arrange for a payment plan.

Yes, I think they can. A friend of my husbands had his bank account frozen by them because he didn't pay his student loan and refused to cut a deal with them.

You have to wonder what they do up there when it snows in half the year. Intelligence is a wonderful thing isn't it?

There is many rules holding to those agencies, they are doing a job and most of them go into illegal actions to gain information and then destroy your name, and credit.

If you payed the bill then what did you need them calling you for?
