Crimes in Canada are nation wide as they are federally controlled. You wont have something legal in one province and illegal in the next. At best, regional police enforcement may have different priority issues.
Prostitution itself is not illegal in Canada. BUT a lot of things associated with prostitution are illegal. Public solicitation is the main one. That means no talking about it or negotiating in the street. If caught even saying "how much?" to a girl can get you charged. So, you can still get caught in a sting if a cop stands on the corner dressed like a hooker. Because of this and you being a visitor unfamiliar with the area, I advise against it.
Other related illegal activities include pimping, body houses, and under age prostitution. DO NOT approach prostitutes that look under age. |

Why are you looking at me when you say that?!? |

Juan B has the correct answer. But an independent woman (or man) can advertise or solicit through internet sites. And, in fact, any understandings or Arrangements that are so negotiated are not only legal but legally enforcable by the courts as standard business agreements.
Also, in Canada it is legal to have a business for partner-swapping as long as there is no cover charge.
When in Montréal check out the Activities Adulte sections of the newspapers. |

Those that have said that the act of prostitution is legal, as defined currently in the criminal code are correct. It's in a grey area at the moment. You CAN prostitute yourself. You can accept "tributes or donations" for providing a sex act in a private dwelling.
You CAN'T openly solicit or negotiate a price in public. You CAN'T pimp (live off the avails of prostitution) and you CAN'T operate or be found in a bawdy house.
As far as Montreal is concerned. Rue St Catherines used to be the main strip, for just about everything. The municipal government has been attempting to clean it up since about 2001 so there's been quite a crack down. Strip clubs and peep shows still abound, where there is still a bit of prostitution going on as there is at the ends of St Catherine and off side streets.
I'm not condoning any of this activity nor am I saying it's evil, but none the less, it's a fact of life and up to the individuals involved. To be tolerant is the first step in being a Canuck. :)
It makes me sorta smile, to see the right wing religious groups that tout "family values" nail anyone that actually has fact. Obviously that's happened in the rates in this question. Grow up. Get a life and stop worrying about judgement until your god (spelled lower case on purpose) gets hold of your behind and spanks you. |

Prostitution itself is not illegal, but various related activities are, such as solicitation. So if you go to Montreal and stop women on the street or sidewalk in order to solicit sex for money you may be charged with soliciting. The idea here is to protect women from harassment and to ensure that normal street and sidewalk traffic are not impeded - basically to take solicitation off the streets. |
