Can an American travel to Cuba legally if accompanied by a Canadian?

I know that it is technically legal for Americans to travel to Cuba, but it is illegal to spend money or receive gifts there. If I travel with my Canadian spouse (and all money is spent by her), am I 100% legal?

No, it won't be legal. The law applies to "all US citizens and permanent residents wherever they are located" and "all people and organizations physically in the United States".

A US citizen can only travel to Cuba with an OFAC license

The license is only valid for humanitarian, educational etc. reasons, not for vacations.

No, not at all. Cuba cannot make any money because of you and even though you say your wife will be "paying for everything" someone is still putting money into the economy on your behalf.

Legally no, but it happens all the time. I have friends (Americans) with family in Cuba. They visited without problems, but I didn't ask the particulars.

People of the United States of America are not free to go to Cuba. They are slaves of their political regime.
However, you can go to Cuba if departing from Canada or Mexico. The nice thing of the Cuban government is that they will not stamp your passport at your arrival.
I am sorry thet people of the United States are not free to travel.

This used to be a popular loophole - get someone else to pay. They tightened the rules a few years ago, so you have to PROVE that someone else paid, by providing receipts for all expenses. (!!)

Also, I have no idea how they apply the rules to spouses - is the spouse not a US resident ? Do they have their own sources of income and separate finances ?

ANY US citizen is NOT ALLOWED in Cuba. You have to have special consent to go there. Doesn't matter who buys the ticket or where you fly from. It is ILLEGAL!

If you really want to go to Cuba, then fly to Mexico City and then take a flight to Havana. when you go through immigration in Cuba they will stamp your visa on a separate piece of paper that you can throw away when you get back to Mexico.. if they even bother with it because a lot of people don't even the that simple a treatment... when they see your U.S. Passport, they will just wave your through.

I just have to laugh at all the self styled experts who always answer this question, who have NEVER DONE IT so, of course, they know all about how a U.S. Citizen can travel to Cuba.

you can buy things but you have to claim them as educational when you go through customs. or you can just let your spouse claim everything.
