Depends. Current travel retrictions allow US Citz to travel to Cuba to see immedaiet family members, for religious purposes, and for education. Regardless of how you go, you need to request permission from the US Dept of Treasury to travel. If you travel to visit family, you are allowed to go one every 3 yrs. For any other purpose listed above, you may travel as often as you are granted permission. Keep in mind however that these travel restrictions change from administration to administration so Obama will most probably change a few things around.

Due to the trade embargo we have on cuba, yes it is illegal to travel there. And with the way they feel about americans, it's pretty stupid to. If you go there your going to spend money there. So it is illegal by the letter of the law.

Can you still go there... YES and if you would just read the ARCHIVES on this question, you would FIND OUT HOW TO DO IT.

Technically, no it is not illegal to TRAVEL to Cuba. What is illegal is spending money in Cuba...that's why the US embargo placed on Cuba -- to not have business trades with Cuba unless you have a specific travel licence. With the travel licence one would be able to spend money in Cuba without 'concern'. That's the real reason.

Many US residents actually travel to Cuba via 3rd country (i.e. Mexico, Canada, DR, etc..) without any trouble. (But Mexico might be a preferrable route for some because, unlike Canada and the Bahamas, a traveller leaving from Mexico does not pre-clear US Customs and Immigration. You will not clear Customs/Immigration until you arrive back in the US. In Canada and the Bahamas you will go through US Customs and Immigration at the airport in Toronto, Montreal or Nassau.)
Cuba does not stamp passports. As long as you come back into the US without any Cuban papertrails, there should be no nothing to be concerned about.

The chances of getting fined are extremely nil....and now it seems that if anyone does get fined, it's as low as $1000.

If you get to see Cuba, it would be an experience for sure. And you'll want to go back again.

Yes, you need a permit. Many people fly out of canada to cuba, but if any problem occurs when you are america will not come and help you. It's still illegal to do that though.

also cheap easy flights from cancun or caracas. The cubans will not stamp your passport and there's little chance of trouble. go! and enjoy!
