The fact of being legal or not means nothing. Since Cuba is a dictatorship, the laws change whenever fidel ( or now Raul ) so decides.
In the case of general Arnaldo Ochoa, accused of drug trafficking, the penalty was prison, but he was shot despite not being what the law said, because fidel thought he was dangerous
Whatever Raul say, is the same thing. They say one thing today and tomorrow they say the opposite
It is not difficult to grasp. As somebody says here, the right we have is to obey ( or follow, which is the word used ) the orders of el Comandante

Yes, as someone mentioned, it is by a firing squad. However, Cuba has not used the death penalty in years even though those who are imprisoned can be treated as those who are on death row.
As of April 2008, the new Cuban President Raúl Castro announced that all death sentences had been commuted to prison terms of 30 years to life, with the exception of 3 people charged with terrorism.
Elizardo Sánchez, president of the dissident Cuban Commission for Human Rights and National Reconciliation, said that according to his group's estimates, around 30 people on death row will benefit from the decision. Some of them have been awaiting execution for more than 10 years.
"This decision was not undertaken because of pressure, but as a sovereign act in line with the humanitarian and ethical conduct that has characterized the Cuban revolution from the start," said Raul Castro. He also noted that party leader Fidel Castro supports -when favorable conditions exist- the elimination of the death penalty for any type of crime and opposes the extrajudicial methods that some well-known countries shamelessly practice. He clarified that this agreement by the Council of State does not mean the elimination of capital punishment in the Cuban Penal Code, noting that under current circumstances the country dismantle itself before an empire that has not ceased to harass and attack the island. |

I will try to help you with an unemotional answer unlike the other people here.
Canada is a Parlimentary Democracy and we have a Charter of Rights and Freedoms these are guaranteed to all Canadians and in fact are also guaranteed to anyone visiting Canada. This Charter guarantees you things like freedom of expression freedom of religion fredom of thought and assembly. It also guarantees that you cannot be held without being charged with a crime it guarantees you the right to due process in a timely fashion (a trial relatively quickly) it guarantess you that no other person or in fact even the State can deny you these rights and Freedoms without the due process of law and a very heavy burden of proof.
On the other hand Cuba which is a Communist Dictatorship run by 1 man for 50 years now sometimes this is called a "cult of personality" in this type of State the rights of the individual are often denied in favor of the rights of the State. And the circumstances under which the State can treat you as they wish are fluid everchanging and diffiult to grasp.
There is of course many more layers to the onion but that in a nutshell is a quick overview.
But Cuba is still an incredible place Her strength is her indomitable population. |
