As John stated - technically it isn`t.
But appears to be due to the non-enforcement of it.

Actually, at the moment smoking a normal cigarette seems a bigger crime (to the government) than smoking weed.

In coffeeshops, where you can buy it, you are allowed to smoke a pure 100% weed joint - but not one mixed with normal tobacco or a normal cigarette - go figure.

btw - Amsterdam is just a city. The rules there are the same as in the country, The Netherlands, sometimes referred to as Holland.

I believe they consider it what they call de-criminalized. Not exactly legal, but they let it be.

Cannabis remains a controlled substance in the Netherlands and both possession and production for personal use are still misdemeanors, punishable by fine. Coffee shops are also technically illegal according to the statutes but, as has been said, are flourishing nonetheless. However, a policy of non-enforcement has led to a situation where reliance upon non-enforcement has become common, and because of this the courts have ruled against the government when individual cases were prosecuted.

Shrooms were banned last year :-(

No,its not legal, but if the coppers raid a coffee shop and you're there smoking a spliff, fear not, you wont get arrested.
Ganja is tolerated,, but I think they'd prefer you not to smoke in the street

Legal or not? Its a moot point. You can buy and smoke without fear of arrest. Thats legal as far as any smoker is concerned. Maybe not for the lawyers among us here.


And yes I guess you could get in trouble if they are stopping you for something else. Although you are aloud to buy 5 grams with no problem.

But if the police see you doing something they do not like they could also arrest you for any number of other things. From crossing against the light to not having the original of your passport with you.

Technically as far as the law it may only be tolerated. But for all practical purposes it is as legal as you would want.

It's illegal to grow or distribute, however legal to use and to sell in coffee shops. You can't just walk around smoking either.

It's legal in certain parts I think, Red Light District, but they are cracking down and downsizing the amount of shops that can sell it.
