I had an accident in FRANCE,and want to take it to COURT,do i pay any costs as his insurance admit liability?

my solicitor doesnt seem to want me to,its been dragging on for 5years and the other driver was drunk,fell asleep and nearly killed us.id have thought it would be an open and shut case. anybody else had difficulty in france? much appreciated thanks

Have you pressed charge to the 'Gendarmerie' or 'Commissariat' at the time of the accident?
Because an investigation and validation of facts by the police would be the starting point as you would need to established the fact for the Court.
Secondly, you need to be advise by your insurance company the action to take if the other party's insurance admits liability. In that case surely not, you won't pay any costs because the Court will ask the drunken driven insurance to pay for all the cost as well in addition perhaps to damage and distress caused to you and your family.

I dont understand what there is to argue in court if the insurance has admitted liability, unless there is something they do not acknowlege. In which case you will have to pay costs if the case goes against you.

Like malcy, I don't understand why you want to take it to court if his insurance admitted liability. Did they already pay you some compensation? If so it may be a closed case (at least where you are concerned).

The DA may want to take action as well if you have informed the Gendarmerie or police (you still can btw).

Now if you want to take it to Court (I don't know how the judge will look at it frankly if my assumption that the assurance already gave you some money is right) you will have to pay the costs for the solicitor and thing like that, but if you win the other guy will be condemned to pay you back those fees
