Why don't people realize that buying "fake designer brands" is a serious Offense in France?


Imports into and exports out of France of counterfeit goods violating trademarks are offenses under French general Criminal Law and the Customs laws. "Fake designer brands" fall into this category. A single purchase of a single item triggers the provisions of the law.

Violators are liable to customs penalties, as well as to penalties provided for under general Criminal Law.

IPR violations are punished under French general Criminal Law with a sentence of two years’ imprisonment and a fine.

Under Customs Law violations can be punished with the following additional sentences:

1) Up to three years’ imprisonment;
2) forfeiture of the counterfeit goods, as well as of the involved conveyances (vehicle, vessel or aircraft);
3) a fine at least equal to the value of the goods and up to twice their value

I agree that these laws are draconian and people need to be aware of them before travelling to France. This is a good place to do so. So I am disappointed by the first few responses to your question.

However, my personal view is that the designers are to some extent reaping what they have sewn, by charging way over the top for their goods. Sure, the counterfeit items are of inferior quality, but they cost only a fraction of the price. So there is clearly some profiteering being made somewhere. But these profiteering designers have the law on their side.
