Do you need the other parents permission to take your child to another country if you are not partners?

I am needing to go to Germany from the UK for a week but will have to take my baby with me but as his dad and I dont stay in touch do I still need to get his permission to take him?

I don't think you need permission, but I'm not sure. You asked in "Travel / Germany", and under German law there might be circumstances where you need permission, but as you're a UK citizen, UK law will apply to you, and I don't know nothing about that.

bruce
no you dont.

Probably depends on whether you (and only you) have the right of custody over the child. If not, it might be classified as child abduction.

reggie
No you don't need his permission

If it's only for a week (as in vacation) I seriously doubt that you need his permission. I think it also depends if you have full or shared custody.

If you have shared custody with the dad of your child then you should let him know of the whereabout of his child if you decide to take the kid with you to another country. If you have total custody of the child then you don't have to. If you have shared custody and you take the child to another country past the length of time you're allow to have the kid it could be consider kidnapping and the other parent could press charge against you. A lot of this is just common sense laws. No offense to anyone. I am familiar with the law and have read the entire UCMJ book for military law. Think about how you would feel if you don't know of your kid's whereabout when his dad takes the kid to another country without telling you a word.
