It all depends if your daughter's father actually is German just being born in Germany doesn't mean he is German.
If he is German your daughter is German too by German law since you are american your daughter would have both citizen ships.

your daughter can apply for German Citizenship if the Father was still a German when she was born if Father was or took American Citizenship before she was born ,then no. My 1st and 2nd Daughters have done this and no problems , my other Children can not do it as by the time they were born I changed Citizenship .She needs proof of her Fathers old German passport ,Citizenship papers and your Marriage Certificate plus her Birth Certificate to clarify her status ,cost I think my Daughters paid $150 all up , Good luck

Your daughter must apply for German citizenship either in Germany or at a German embassy. Technically, she has the right to apply for citizenship, BUT: She cannot apply before she's 18, and if she doesn't apply within a time span of (I think) five years, she'll have abandoned her right. You should ask the German embassy in Washington D.C. for details. As far as I know, you cannot apply on her behalf. Maybe the father could, in Germany.

The German Citizenship laws is totally different as USA laws that is based on place of birth (USA) and affiliations. The German laws is based of father citizenship ( Germany is a land of Fatherland) and not at all of place of birth.
Your daughter can asks for German citizenship at German Consulate in NY if her father was German Citizen. If you are married with a German Citizen you are allowed to live in Germany and after 4 years of common living you are allowed to ask for a German Citizenship. A German Citizen is also Citizen of Europe, that means that he can live, work, study for free in any 26 other country of European Community.

One thing people did not mention is that Germany has very strict laws regarding dual citizenship. If she were to obtain German citizenship, she would have to relinquish her US citizenship. Better to apply for residency that way she doesn't give up all rights in the UNited States. YOu can never reverse it once you relinquish citizenship.

I forgot to mention if dual citizenship is obtained as a youth, you hold it only until a certain age I believe 21 or so, and then you have to choose which country you want to be a citizen of you cannot have both.
