Help!! I need legal advise in Germany!!!?

So essentially I am having issues with my former roommate. We used to share a flat together and to make a long story short, I had to move out. He is German and I am American. This guy scammed me and basically kept more than $1000 worth of my belongings.

I have reported this to the police but there is nothing else they can do.

Can someone tell me about the legal avenues I can pursue? Keep in mind I will be leaving back for the USA in a few months and I don't really have money for a lawyer.

This is totally unfair and I feel hopeless. So many things with sentimental value lost to a total jerk in a foreign country. I feel determined to not be a victim and let this person get away with it but it seems he has the upper hand.

Tell me it aint so! Someone please help!!!!

It is likely that I may have to resign my desires for getting my belongings back.

We signed no contract, I was just living in his flat. Only a verbal agreement. I knew I was setting myself up for trouble, I got into this situation my second week of being in Germany for my year long study abroad.

When you moved in, did you sign any contract? or did he sign or did you both have a contract at all?
I don't think without a lawyer you can do much in this case.
The Mieterschutzbund is not the right place here it is for quarrels between the person who rents an apartement and the owner of the apartement.
Sorry I have to disappoint you but you really need legal help do you know that in case you can't pay a lawyer you can get 'Prozesskostenhilfe' by the state?

Can you explain that please you would need wittnesses and a non written contract makes a legal issue a lot more complicated.

Yeah, it sucks but stuff like that can happen with roomies. If the police will not do anything and getting a lawyer will end up costing you more than the stuff, that is if he still has it, there is not much you can do

Well, I guess aside from breaking into his apartment and taking it back but that could land you in even more trouble. Chalk it up to lesson learned I guess.

Two things I would recommend as next steps:

1) You said, it' a one year study? If you're at a universität, they have a student organization called asta "Allgemeiner Studierendenausschuß". Usually they communicate between students and university, but they also help students - at least I would expect they would know who else can help! An advise would be free of charge.

2) You can go to a lawyer and ask for "juristische Erstberatung" - a kind of first informative conversation. Costs are limited to 190€, but I'm sure, some would be available for less (I saw rates about 69€ in the internet) - "juristische Erstberatung" means, they take an hour of their time, listen and try to undrstand what happen. Then they explain whether there is a chance to go to court or whether there might be another way to get help. Btw - If you go to court and win, the other party has to pay for your lawyer.
If you can't effort 100€-190€, you can go the "Amtsgericht" (small local court). If you can convince them that you can't effort "juristische Erstberatung", they will issue a "Berechtigungsschein" (kind of attest) which grants you to get "juristische Erstberatung" for 10€ instead 190€.

Btw - a contract between 2 parties doesn't need to be written in germany. Sure, it's easier and more clear for everybody, but legally not necessary, means you haven't lost all rights and can't do anything.
