Well, considering they tried to catch the bear alive for quite a while, and considering that the bear started getting close to settlements... No, I don't think that the hunters who shot the bear should be punished.
Bavaria and even the Alps isn't a remote area with no people in miles, and a bear isn't a puppy. Having a bear run around in a densly populated area like Germany is akin to letting a bear run wild in the suburbs of, say San Franscisco. That said, of course it would have been preferrable to catch the bear alive and tag him so that you can monitor his movements and scare him off from human settlements... but if the bear is no longer avoiding human settlements, it becomes a danger. Sheep and goats don't matter if he eats them, the costs for them are covered. But at one point he'd most likely taken on human prey, too, because he no longer was afraid of humans and tried to avoid them.

That whole story is just a farce. They should be punished, and we need some rules to make sure something like that doesn't happen again.
