In train,if a reserved passenger doesnot turn up at his boarding point, what action a TT can take?

During a recent train journey, myself along with family happened to report to TTE five stations after the boarding station, but found that our reserved berths awarded to REC passengers. Few more such cases were reported on the same journey. In such a situations, how the rights of passenger can be protected?

What passenger rights are you talking about ?
Are you a first time railway traveller?
Are you not aware of the railway rules and regulations ?

Read the railway rules first:

CANCELLATION OF RESERVATION DUE TO LATE ARRIVAL OF PASSENGER :- If a passenger, for whom a berth or seat has been reserved, does not turn up up to 10 minutes before the scheduled departure of the train, the Railway Administration may cancel the accommodation reserved for him and allot it to the passenger on the RAC list/Waiting list accordingly on priority.

CHANGE OF BOARDING POINT :- If a passenger desires to occupy reserved accommodation from any station enroute, he would be permitted to entrain at any intermediate station he chooses irrespective of the distance from the starting station subject to the following conditions :-

A specific request must be made in writing at the station from where the ticket is purchased and reservation made atleast 24 hours before the scheduled departure of the train from the starting station.
The Railway Administration reserves the right to use such accommodation from the originating station up to the station at which the passenger is due to entrain.
No refund will be permissible for the portion of journey not performed by the passenger.

According to the railway rules, a passenger must board the train only from the boarding station and in addition to this, the passenger must also arrive at the boarding station at least 15-30 minutes before the departure time of the train. Also, you can not board the train even from a station which is before the boarding point station as mentioned on your ticket because the berth that is alloted to you could be alloted to some other passenger whos journey will be over at the station from where your journey begins. Normally, passengers are allowed to come at anytime so long as they come on the platform of their boarding point station before the train departs and in some cases, the TTE even waits till untill the next station for the passenger to show up. But, If the passenger fails to board the train at the boarding point station or even at the next station after that, then the TTE is fully authorized by the railways to allot that passenger's berth or chair to the next RAC passenger in the list. It is unfortunate that this has happened in your case. But, the TTE, in his capacity as a railway officer, has the right to assume that the conernced passenger may have cancelled his reservation after the chart has been displayed or may have decided not to undertake the journey at the last minute; And in doing so, the TTE is dutybound to provide that vacant berth or chair to the next RAC passenger in the list. This rule has been specially framed by the railways with the intention of providing quality service to all its passengers. However, you can still claim 50% of the ticket amount as a refund from the boarding station even after the train has left. If you still feel that this is an unfair practice, you can plead your case before the railway disputes and claims tribunal or even at the consumer forum in your city but I seriously doubt if you will be able to secure a judgement or a ruling in your favour since, in this case, it clearly does not appear to be any lapse on the part of the railways.

So, from the next time onwards, please be more attentive towards things like this.

those berths are supposed to be allotted to
rac passengers.you have to board the train
at specified station.[at least you get 50 %
refund in such situation,if its air ticket you will be getting
taxes only] .

The TT is expected to wait for next two stoppages and the passenger missed the train unfortunately at the boarding station can somehow come and get into the train. After this only the TT can allot the berths to RAC Passengers You can report to him and if he does not oblige you you can pull the chain in the next station and stop the train to get redresal. Also there is a complaint book with the guard and you can make a complaint there giving TTs name and badge number.

This is the rule - but for your information.

The TT must have been in a hurry to finish his work and take his usual booze. after taking the drink he had not listened to you . You should also include this (if I am right) in your complaint.

You can also send a e-mail or letter to Mr. Laloo Prasad giving all details. Your name train no. PNR No. Berth No. date, TTs Name and badge Number etc.

Till T T does not come to your compartment to check the tickets, he can not do any thing, neither cancel , nor endorse your bearth. Once T T comes to your compartment, generally T T comes with in 15 minutes to one hour or within next two stoppage in gap of two hours, but no rule is fixed.

If TT comes and checks all bearth of the compartment and you have not reported , he can give your bearth to next RAC passanger and give remark to you in his chart NOT TURNED, in that case you can not do any thing except on TT mercy. T T can not cancel the reservation of the passanger to whom he has awarded your bearth once entered on his chart and written on ticket.

Yest T T can accomodate you on any other bearth in same or any other compartment if there is any vacant bearth.

I will say, in case you have to board the train after five station and knew earlier, well in time, before prepartion of the chart you can give your request to railway to note your boarding station, in that case T T will wait till your boarding station.

Any way, i am confident, you will take care in future.

After reading others answer, I would say, you can get your ticket cancelled for origin station, if you are at fifth station from origin destination, and train departure time is over, ticket can be cancelled from fifth station but you will obtain a certificate from that fifth railway station Incharge that you are not travelling after this station, then you will be issued a ticket cancellation certificate and refund amount will be sent to you by DAK and demand draft only at your address given to them.You will get refund after deducting the fare from first origin station to fifth station where you are getting ticket canceleed as no body know after arrivcal time of train at fifth station, you actually have enjoyed the journey or not.

Any way, you can check the rule of refund, clearly mentioned in any railway time table.

TT can allot the seats to somebody travelling in the same Train after checking your non-existense.

abcd has spelt out in detail. In practical situations, the TTE has to wait till the next scheduled stop before reporting the reserved tickets as "did not turn up" and proceed as per the rules.
However you may make a claim of refund. In case it is rejected, you may approach the consumer forum, that the rejection is not valid, as the railways have not been lost due to your absence and hence should not charge you and refund you with the reservation charges at least, even if the journey is completed. Before making a claim you should have got your tickets endorsed with suitable notations such as journey not undertaken, etc.

Adding to what others have answered and by a reading of the sequence of events narrated by you, the Railways dont seem to have breached any rule attracting the provisions of 'deficient servce'. Hence the chances of getting a favourable verdict for you at the Consumer forum seem rather remote.
