Help me,got punched outside a pub.please help,from south of ireland? |
i went out for a quick drink with freinds on x-mas eve,the pub finished went outside to wait on my freinds and got punched in the face and back of the head from a fella who was in the pub that was drunk,i drop my work keys with a small pen knife on it that i use for work,i was going to hit him back with my keys but i walked away,next min the gardas stop me and seached me and found my keys with de knife on it,brought me in to a cell,there doing me now for having a knife.i told them wat happen but no joy.any ideas wat will happen to me or wat should i do in court?please help any1 who was in this position before |

Ireland has gotten a lot stricter on knife crime and it is a crime to carry one as that is seen as intent to injure another. Too late to tell you NEVER carry ANY sharp object on your person whether you work with knives or not it is illegal. How old are you? Have you seen a solicitor? You had the right to one when you were arrested although I doubt you saw one on xmas morning! You must go to one & get the advice you need they will tell you everything you need to know. The fact you did'nt hit this guy says a lot and you should be asking the pub owner to make a copy of his cctv footage, he need'nt give it to you, he can give it to the garda station in question to prove that you were hit and did'nt hit back. If you have no previous record the judge will hopefully be lenient but I would say you will get a fine and community service or something, if you have previous convictions you can expect the judge to be annoyed with you and punish you more but with the correct legal advice this can be sorted. |

i'd say your best bet is to plead your case at a later date personally with the guard who is associated with your case. if he still is bringing you to court, then you'll have to get a solicitor to plead your case. but if your in a job that requires the pen-knife and they see that your not just some scumbag then they'll be very lenient. so you should be grand. also if you can get a reference off your local garda station and a copy of your record under the data protection act(provided your record is clean), that will help also. |
