Ireland only. a tradesman wont finish work already paid for what can i do? |
I hired a man to landscape my garden he hasnt finished the job although i paid him in full (stupid of me iknow)
I wrote to him and we had a meeting he promised to finish but he hasnt and he probly wont now.
I have contract receipts etc to prove I paid him and photos work uncompleted.
the small claim court is not suitable and my solicitor said to think hard about trying to sue him as mostly they just dont pay and nothing really can be done.
i paid him 11k and he has done about 5k worth of work.
I am at the end of my tether - please advise thanks
I am in ireland by the way so would appreciate answers based on laws here thanks Additional Details small claims court only goes after debts up to 2 or 3 k im not sure which. thank you so much everyone for you input I am getting lots of ideas. keep em coming thanks |

If the courts won't help you, you could go public about it, but I think it's enough of a claim to go to court over it. Get a solicitor from a small firm, someone like that is more likely to be hungry and fight for you.
Badmouthing someone on public radio or whatever might not really help you - you could end up being sued for slander.
Another thing you could do is report him to the Revenue Commissioners - he has taken money from you, you gave it to him for services he agreed to do for you, but didn't. Send them a letter stating this, giving his name and details, and copies of all the agreements you made with him. I would say you will be hearing from him very quickly after this. Put your original receipts and other agreements with him in safekeeping, outside of your home. |

can your solicitor write a letter threatening to take it further if he doesnt either refund or compete the work....it might be enough to give him a bit of a fright.

you should try to shame him into doing it like going to joe duffy and making a big issue out of it (i know it sounds like a really trivial answer for such a huge issue but it might just work,and wouldn't it be great if it did?)
you should his union if he has any, is there an ombudsman? try the irish consumer agency, they're there to protect your rights and paying for work to be carried out and when its not is a violation of your rights!
you should also try to contact people who have been in the situation before, again all i can think of is the radio.
sorry i cant be of any help, i really hope you get this solved soon, its such a horrible situation to be in.

Ouch, £6000 loss is one hell of a way to learn a lesson, if your own solicitor has advised against trying to sue i would listen to him. He would make more money from legal fees by taking the guy to court so by advising you not to he is shooting himself in the foot. At least you have an honest solicitor. |

Maybe it's not the right time of year for him to finish the job, and he can't complete it until next spring.
I'm waiting for someone to level, stone-pick and seed my garden, but he can't finish the job now because of the weather, but next spring he will.
Try to get the guy to commit himself in writing. If the job doesn't get done, then your best option is the local radio station. Complain to them. |
