According to Polizia di Stato website (official Italian Police website), currently there are just two product approved for carrying with oneself; they (a pen and a key-ring) have a modest amount of Oleorisin Capsicum or Black Pepper; product not approved by the Minister are considered an "arma propria", an object made with the specific purpose of giving physical damage to somebody; some kind of "armi proprie" can be kept and used inside one's own house with no license, but cannot be brought outside; that's for other kind of pepper sprays other than the two mentioned above.

No, it's not legal though lots of gilrs and women use it because you never know. Better be fined than sorry.
