Was your son born in the USA?
Are you legally married, or do you have a common law marriage?

You need to visit your local Mexican Consulate and:
- register your son as Mexican; even if he was born here and the USA recognize him as American by Mexican law he is also Mexican. Get him a Mexican birth certificate.
- your husband needs his passport. If he does not have one he needs to obtain a valid id from consulate;
- you need to obtain an apostille copy of your marriage certificate.

You both need to travel together to Mexico with your son. Upon entry they will ask you for all the papers above.

Once in Mexico you both need to "register" your marriage in Mexico. That is why you need the apostille copy. You will also need to present a valid translation of marriage certificate.

Once you have registered marriage you have to go to Mexican immigration and apply for a resident visa FM-2

I would encourage you to do everything you can to help your wife become legal and stay in the united States. It is extremely difficult for a foreign national to get a work visa in Mexico. Wages are extremely low. You would have a terrible time making a living. The other answerers are not addressing the actual practical issues here.You would only qualify for a 6 month tourist visa, not a longer term residence visa, unless you can prove you have a steady monthly income of about $2000.00 a month for a family of 3. Then you have to return to the border to renew that every 6 months. You have to find an employer who will give you a job and write a letter stating that he cannot find a Mexican national to fill that job, in order to get a work permit, and that is hard to do unless you are a highly trained professional. Put your efforts into finding a way to stay in the United States. I live in Mexico and i love it, but i am retired and have a steady income. Most Americans in Mexico are either wealthy, retired or both. It is almost impossible to make a living here, for young people like you.

you don't need anything but your passport, I lived there for about 8 years and I had no problem, If you choose to purchase anything like a house or a car there in Mex. you would not be able only your spouse or whoever is of Mexican citizenship to do so. But other than that I think you are going to love it I know I did.... Good Luck
